1) Scope of Application

1.1 These Terms and Conditions (“Terms”) apply to all contracts for the sale and delivery of goods concluded between epic steps (“Seller”) and consumers or businesses (“Customer”) via the Seller’s online store. Any differing conditions of the Customer are hereby rejected, unless expressly agreed otherwise in writing.
1.2 A “consumer” is any individual purchasing goods primarily for personal, family, or household purposes. A “business” is any individual, corporation, or legal entity acting in the course of trade or business.

2) Formation of Contract

2.1 Product descriptions in the online store are not binding offers but serve as an invitation for the Customer to make a purchase offer.
2.2 By placing products in the online shopping cart, completing the checkout process, and clicking the final order button, the Customer submits a binding offer to purchase the goods in the cart.
2.3 The Seller may accept the Customer’s offer within a reasonable period of time by:

  • sending an electronic order confirmation by email, or

  • shipping the goods to the Customer, or

  • charging the Customer’s payment method.
    The contract is concluded at the moment the Seller takes one of these actions.
    2.4 When using PayPal, Stripe, or other third-party payment providers offered in the checkout, payment processing is subject to the terms and conditions of the respective provider.
    2.5 The Seller will provide the Customer with a copy of the order details via email after purchase. The Customer is responsible for ensuring the accuracy of their email address and for checking spam filters.

3) Return & Refund Policy

3.1 Customers generally have the right to return products as described in the Seller’s Return & Refund Policy, available on the website.
3.2 Details regarding eligibility, deadlines, and return procedures are set out in that policy.

4) Prices and Payment Terms

4.1 All prices listed in the online store are in U.S. dollars and, where applicable, include sales tax. Shipping and handling charges, if any, will be displayed separately during checkout.
4.2 Accepted payment methods are communicated during the checkout process.
4.3 Payment is due immediately upon order placement unless otherwise agreed.
4.4 For credit card and third-party payment processing (e.g., PayPal, Stripe), the Seller reserves the right to deny transactions in case of failed authorization or suspected fraud.

5) Shipping and Delivery Conditions

5.1 Goods are shipped to the delivery address provided by the Customer during checkout.
5.2 If delivery fails due to reasons attributable to the Customer (e.g., incorrect address, refusal of acceptance), the Customer may be liable for additional costs incurred.
5.3 In-store pickup is not available unless otherwise specified.

6) Retention of Title

Title to the goods remains with the Seller until full payment of the purchase price has been received.

7) Warranty Disclaimer

7.1 The goods are provided “as is” and “as available,” without warranties of any kind, whether express or implied, unless required by law.
7.2 To the extent permitted by law, the Seller disclaims all implied warranties, including merchantability and fitness for a particular purpose.
7.3 In the event of damage during transit, Customers are encouraged to report issues promptly to both the carrier and the Seller.

8) Governing Law

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of [insert applicable state, e.g., California], without regard to its conflict of law rules.

9) Dispute Resolution

9.1 Any disputes shall first be attempted to be resolved amicably by contacting the Seller’s customer support.
9.2 If no resolution is reached, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Class actions are not permitted.
9.3 Nothing in these Terms limits a consumer’s rights under applicable U.S. consumer protection laws.
